Related Articles UKGC hails ‘delivered efficiencies’ of its revamped licence maintenance service  August 20, 2020center_img David CliftonLast month the Gambling Commission announced the results of its review of complaints processes in the gambling industry, carried out one year after the introduction of the Alternative Dispute Resolution (ADR) scheme.As matters stand, ADR providers can look only at disputes about the outcome of a gambling transaction, rather than the way a gambling business is being run, which is instead a matter for the Commission as a regulator of the gambling industry. However, a downside for the consumer is that:the Commission does not provide a complaints service and will not investigate individual complaints andwhere a ruling on the outcome of a transactional dispute may depend on the outcome of an investigation into an operator by the Commission or by another body, it is difficult for ADR providers to adjudicate.None of this prevents the consumer from taking their complaint to court whether they are dissatisfied with the outcome of an ADR provider’s decision, or for any other reason, but that will usually be a costly exercise, something that the ADR process is supposed to prevent.The Commission says that its review has:shown that currently, “the complaints system in the gambling industry is not working for consumers, who have found it difficult to access, time-consuming to use, and they question whether it is independent and transparent” andidentified “a clear need for both gambling businesses and ADR providers to improve the way they handle consumer disputes”.The Commission certainly has the power to bring about such improvements because it is not only able to impose more rigorous requirements on operators pursuant to the LCCP but it is also responsible for approving ADR providers pursuant to a process that requires providers to meet, and to continue to meet, requirements of impartiality, fairness and independence.Currently, there are eleven such approvals, although the Commission reports that in the year to 30 September 2016:IBAS dealt with 93.6% of all disputes in the British gambling sector,eCOGRA dealt with second largest number of disputes with 5.2% of the total,the remaining 1.2% of disputes were split over a further six ADR providers andthree providers did not receive any disputes between 1 October 2015 and 30 September 2016.This review has been conducted against a backdrop of concerns on the part of the Commission about what it perceives to be an increasing lack of public trust in gambling operators. It cites recent survey data showing that 61% of respondents who gambled during 2007 thought that gambling was fair and could be trusted, whereas by 2016, only 38% of respondents thought this to be the case.In addition, the Commission says that last year it received nearly 77,000 contacts from members of the public, representing an increase of over 300% on the last two years, as a result of which it has concluded that existing complaints arrangements in the sector are not meeting consumer needs. In addition, it has concerns that the number of disputes recorded:by non-remote operators has increased from 4,548 in 2014 to 11,398 in 2016 andby remote operators has increased from 10,635 in 2015 to 12,100 in 2016.The Commission wants gambling operators to take complaints more seriously by operating complaints procedures that are “genuinely accessible and give consumers trust that their concerns have been listened to and acted upon in a timely way”. It wants ADR providers to consider whether they are doing enough to help raise standards in this industry and to ask themselves whether (a) they could do more to drive change by sharing learning from complaints and (b) their processes and contractual arrangements with operators allow them to consider complaints fully, independently and transparently.For its own part, the Commission intends to put in place rules and standards that support and, where necessary, require more comprehensive approaches to complaints handling by both operators and ADR providers.We can expect that this will include the following:in order to make it easier for consumers to make complaints, introduction during the middle of this year of “Resolver”, an online tool that supports consumers to raise complaints and is independent from gambling businesses; already in use in a number of sectors, including energy suppliers (for example, British Gas, EDF Energy), public services (for example, HM Passport Office, DVLA) and others, it explains the consumer’s rights in simple terms, helps the consumer to prepare an email using a template, allows the consumer to record all communications in the same place, creates a case file for the consumer and tells the consumer when to escalate their case to the next stage,subject to consultation, improved instructions to operators how and when to send correct data to the Commission and, possibly, a new requirement for operators to provide more information in their complaints policies and to make them more visible,a possible reduction or limit in the number of approved ADR providers, coupled with a framework of requirements including standards around customer service, decision making, and supporting the gambling industry, anda review of governance arrangements intended to (a) make the role of an ADR provider clearer, (b) improve consistency, and (c) help to reassure consumers that a provider is independent of the gambling business.The Commission’s review document (that can be read in its entirety on our website via the link at http://cliftondavies.com/review-complaints-) also reveals the following information that is directly relevant for betting operators.The largest number of complaints made in retail gambling are in the betting sector, which the Commission says is not surprising because there are more betting shops than other licensed gambling premises – for example, there are 8,709 betting shops compared with 575 bingo premises and 148 casinos in Great Britain. However, the Commission has concerns about the accuracy of the complaints data that operators are reporting. It states that data provided by betting shops indicates that on average only 3.3 complaints per shop went unresolved at the first stage of their complaints resolution process in the whole of 2016 – a figure that it considers to be “unrealistically low”. Instacart workers go on strike after the company does not meet demands

first_imgEmployees of Instacart are reportedly on strike after they say the company’s response to their demands for more coronavirus protections was more like a “slap in the face.”The Gig Workers Collective announced that the worker’s strike on Instacart will take place on Monday after the company’s response did little to appease their demands.Due to the coronavirus, many families are now turning to online grocery delivery services such as Instacart to do their shopping and to cut down on the amount of time they spend in public, however, this still leaves the workers “risking their lives for pocket change.” Employees for Instacart specifically, are demanding that the company provide hand sanitizer and facemask to all workers, add an extra $5 in hazard pay for every trip they make, and for the company to offer sick pay for workers who have to stay home due to underlining health conditions among other demands.After hearing from both workers and shoppers, the company has responded to the demands saying that it has sourced hand sanitizer that will ship next week, that they will enact a “leave at my door” feature to cut down on face to face interaction, 14-days of sick pay for all employees diagnosed with the coronavirus, and that part-time employees are now how access to paid time off as an accrued benefit.Despite the response, the Gig Workers Collective says workers have been asking for change for months and that the response is too little too late.It is unclear how many workers plan to participate in the strike, however, the impact may be significant as many people have come to relay on delivery services as a way to acquire their household basics and the company was already struggling to keep up with it’s increased demand.last_img read more

Promises, promises

first_imgEvery so often columns just jump into your lap, maybe not just exclusive to pro football in particular, but sports in general and how the average “Joe” feels about subjects related to the sports that may or not be just about first downs and interceptions.From here on; I will be attempting to recall for you the conversation that I was privy to while in route to the Homestead Waterfront, just a tad outside of Pittsburgh. I was on the Waterfront shuttle with two forty-ish White males with their tool belts still in place. They both appeared to be dog tired after a long, hard work day.Average “Joe” number one, or AJ1 asked average “Joe” number or AJ2 what plans he had for the weekend. “I am going to go in and get ready to go out for a little while;” AJ2 said, with a tired but broad smile stretching across sunburned face. “What about you?” AJ1 said, “my loot is sort of funny so I’m gonna stay in and watch Penguins and Steelers reruns. I don’t care how many times I watch the Steelers Super Bowl highlights, just like when I watch a good movie more than once, I always miss something; ya know what I mean?”At that point AJ1 seemed to become a bit irritated with his work mate. “I love the Steelers as much as anybody’” he said. “But I refuse to pay ESPN, the NFL network or any other station to watch reruns. Hey, we won’t get paid next week for the week we just put in; so why should the players or the networks get paid for games that have already been played?”A puzzled expression came across the face of AJ2. He appeared as if he had no response but finally a light clicked on somewhere. “I just like the game and I am not a politician or anything like that; so the money that they make well, I can’t control that.” “Oh, I know” AJ1 said, “but they find so many ways to make money off of us.” AJ2 now started to now get a bit emotionally involved. “Well if it was all about money, that didn’t stop Junior Seau from killing himself, did it?” At this point AJ1 seemed to be getting just a bit ticked off at his homeboy. “Hey that is why I follow high school football because those kids play with heart and because they love the game, not because of the money. Look at all of the money that Mike Wallace wants. He is an ungrateful young bas–rd! After all the Rooneys did for him, now he wants to break the freakin’ bank. These guys make too much money anyway just for catchin a ball.” At this point I thought to myself; what have the Rooneys done for Mike Wallace aside from paying him for a day’s work? Just like all of us average “Joes” want to be paid. But it’s not about my thoughts, right? Anyway, AJ2 came back a little passive but smart, “if you come over to my house we can pitch in on a case of brew get a sandwich ring and watch Pens highlights, plus the money that you are gonna spend for a couple of beers down the south side hell; we can buy a case of ‘Milwaukee’s Best.’”I had to get in on the action because if I didn’t, I’m sure that I would have burst wide open. “Hey do you guys know what stop I get off to get to Office Depot?” (I have only been there in all honesty over 100 times.) AJ2 seemed to view this timely intrusion as the perfect opportunity to exit from the previous conversation. “Yeah, the bus is going to turn into the mall (huh?) from Ann Street. When he makes the right turn you will get to Giant Eagle. That will be the last stop before the bus leaves the “mall” going back to Pittsburgh.” I said thanks to him but at that point the former conversation seemed to have left him a little discombobulated because he answered my thanks with, “thank you.”There are segments of society that have a “hate success” gene built into their DNA. But don’t hold them entirely at fault because for centuries the ruling class has dangled carrots of hope and possibility in front of their faces. As music legend George Duke once said, “the preacher’s on TV selling God today.” Look at the selling of the death of Trayvon Martin.The only thing that most of the talking heads say that means anything to them is; “we’ll be right back after this commercial break.” Why aren’t the CNN trucks parked outside of the Mon-View Heights housing project where two young African-Americans recently lost their lives in a senseless “gun battle.” Where are “the great reverends” Al Sharpton and Jesse Jackson when you need them? Young Black men better get it together. Rest in peace better start to mean; get a good night’s sleep to get ready for work.
