This is obviously good for the economy and good for the mortgage industry, even if it is not the best news for those of us working in default. According to Black Knight, August 2019 saw foreclosure starts hit their lowest level in 18 years. October 2019 saw national delinquency fall to near the record low, which had just been set in the previous May. There are many reasons for this, from a strong economy to the success of the myriad regulations placed on the mortgage industry following the crisis a decade ago.But there is another more surprising reason. Certain borrowers are not defaulting in the way Congress expected, specifically high debt-to-income (DTI) borrowers. Simply put, the Consumer Financial Protection Bureau (CFPB) requires lenders to perform a DTI calculation to assess the risk of borrower default. The CFPB prevented lenders, with the notable exception of the GSEs, from offering qualified mortgage loans to borrowers with a DTI ratio higher than 43%, with the theory being, the lower the DTI ratio, the less chance a borrower would default.This, however, has not proven to be true. In the three years immediately following the implementation of the Qualified Mortgage (QM) GSE Patch, which exempted Fannie Mae and Freddie Mac from the 43% threshold, the 90-Day default rate for GSE purchase originations with borrower DTI over 45% was significantly less than the same originations for borrower DTI between 30% and 45%. In 2016, for example, the ratio of default for borrower DTI over 45% was as little as half that of DTI 30% to 45%.This pool of high DTI borrowers is by no means insignificant. It was estimated by CoreLogic that roughly 16% of all 2018 home originations stemmed from the GSE Patch, amounting to approximately $260 billion worth of loans. That percentage of originations would likely be much higher, but the CFPB legislation surrounding the QM GSE Patch has, thus far, kept private lenders from providing qualified mortgages to these individuals.However, if this pool of borrowers isn’t particularly risky, why then are private lenders being prohibited from granting them qualified mortgages? The answer to this question does not seem to be particularly clear, unless one posits that Congress just got it wrong. While DTI can certainly be a useful statistic, it by no means should be the seminal one when determining which borrowers should or should not receive a mortgage. Readily available data, such as a FICO score or simple loan-to-value ratio (LTV) have been shown to be much more effective predictors of default. Frankly speaking, DTI caps are just plain unnecessary.This unresolved issue is reaching a level of urgency with the GSE Patch set to expire on January 1, 2021. This large segment of borrowers, undeservedly stigmatized, will have even fewer options should the Patch expire with no changes to the DTI requirements. Though borrowers would be able to qualify for mortgages with FHA, VA, and USDA, a large portion would be forced to explore the non-QM space. This would require lenders in turn to expand a space structured for a smaller pool of non-W2 borrowers into one able to accommodate an increase of literally one-sixth of the number total originations. This expansion would be a boon to private mortgage lenders, to be sure, but an expansion with unnecessary growing pains.A much simpler solution would be to modify Appendix Q to significantly raise, or drop altogether, the DTI Cap. As it stands, Appendix Q—which sets the standards for determining debt and income for potential borrowers—contains requirements for employment history verification, income stability, and qualifiers on non-standard full-time employment. These standards could be left fully intact and used to calculate DTI for a higher ratio, such as 50%, with little else needed to maintain effective regulation. Based on the statistics from 2018, this would account for over 300,000 additional borrowers having access to private QM lending, who otherwise would be dependent on GSEs or Non-QM.The bottom line is that a large pool of high-quality borrowers with a low rate of default exists, and private lenders are willing to lend to them, but the government is standing in the way. The expiration of the GSE patch is a step in the right direction, but a step that will leave everyone off balance if it is not also accompanied by changes to Appendix Q. It would behoove everyone if Congress stopped extending deadlines and started revisiting DTI, so that an orderly transition can be made on January 2021 with a solution that benefits all parties. Ride Today, Ski Tomorrow

first_imgI spent a year living in Southern California learning how to surf. During the colder winter months, I had the dream of pulling a double—skiing in the morning and surfing in the afternoon. It is, quite possibly, the perfect day, made even more perfect because the two adventures are diametrically opposed; There aren’t many places where you can shred powder and waves within a couple of hours drive of each other. It eluded me while I lived in SoCal because, you know, work, but since living in the Southern Appalachians, I’ve gotten to enjoy a different kind of double—ski in the morning, mountain bike in the afternoon. Logistically, this is much easier to do in here because our skiing is isolated (and largely manmade) and there’s killer mountain biking everywhere. Still, it’s a hell-of-a day that leaves your legs wrecked and your soul recharged.I’ve knocked out a handful of doubles over the last several years, but so far, this year, it’s eluded me. Again, work. But I’ve found the next best thing: ride today, ski tomorrow. It was 50 degrees and sunny earlier this week in Asheville. My local trails were dry and I carved out an extra hour during lunch so I could put in a quick, 10-mile ride on sinuous singletrack. The next day was brutally cold at my local ski hill for Whiskey Wednesday. The snow guns were blowing as we hit the slopes in record numbers for a post-work ski session under the lights. It’s surreal to go from perfect biking conditions one day to arctic skiing the next. It’s almost as odd as bagging both adventures in the same day. You shouldn’t be able to do this—riding singletrack one day, skiing the next. Life shouldn’t be this good. And yet…ski tomorrow 2 (1) (1)Of course, beer made it all the better. After the bike ride, I went with something sessionable—Oskar Blues Pinner at my favorite neighborhood lunch spot. I still had work to do, after all. But I was worked after three hours of skiing blissfully sketchy terrain. The only thing to do in that situation is begin rehydrating with a series of  IPAs. I chose Highland Brewing Company’s newest beer, simply called, Highland IPA, which is by far the best single IPA they’ve ever produced. It falls in line with the modern West Coast mentality of being fruity and citrus forward thanks to a trifecta of hops from the Pacific Northwest (Chinook, Citra and Centennial).There are no scientific studies to prove the regenerative properties of a good IPA, but after a few of Highland’s finest, I could feel the energy and power moving back into my legs and I began to wonder if I could carve out enough time tomorrow for another mountain bike ride. Hallandale Beach CRA Creates $500,000 Stimulus Program to Assist Local Small…

first_imgBusiness Employment Bridge LoanThe Business Employment Bridge Loan is a forgivable bridge loan designed to work in conjunction with other federal and state programs in order to provide a direct cash incentive for small businesses to keep their workers on the payroll. Under this program, businesses are encouraged to rehire those that they may have previously laid off. The program is an acknowledgement of the challenges that many businesses have with accessing funds at the federal and state levels due to the extremely high amounts of applications that are being received by agencies associated with those entities. Businesses that apply for and receive the funds, are required to prove that they have applied for various Federal and State loans. Additionally, the CRA has added an innovated component to the loan which requires those receiving the loan to pay a living wage to their employees, and, if the business happens to be a restaurant, food that would normally be thrown away at the end of the night must now be donated to a local shelter or food pantry as a part of the CRA’s Zero Food Waste program. The Coronavirus Small Business Sustainability and Recovery Loan Program is comprised of two separate loans, the Business Employment Bridge Loan Program with loan amounts up to $50,000, and the Emergency Business Cash Infusion Program with amounts up to $15,000.  Both loans are available only to those businesses located within the Hallandale Beach Community Redevelopment Area (CRA). In accordance with Florida Statute 163 Part III, the loans are not available to businesses outside of the CRA. The goal of the program is to provide businesses located within the CRA area with immediate financial relief to avoid temporary or worse, permanent closure.  The HBCRA Board will vote this Wednesday, April 15, 2020, to approve the Coronavirus Small Business Sustainability and Recovery Loan Program. According to Dr. Jeremy Earle, the Executive Director of the CRA, as well as an Assistant City Manager, “the CRA is taking an innovated step in ensuring that, not only will a local business receive the financial help that they need during these challenging times, but that the employee is also paid a fair wage.  Additionally, the CRA wants to ensure that, where it can influence the process, restaurants that would typically throw food away at the end of the evening would now be required to donate that food to a shelter or pantry as a part of the CRA’s Zero Food Waste Initiative. The initiative will help to feed the increasing numbers of those who are facing food insecurity.” Emergency Business Cash Infusion LoanThe Emergency Business Cash Infusion Loan is a partially forgivable bridge loan, designed to work in conjunction with other federal and state programs in order to provide a direct cash incentive for small businesses to help them through this challenging period associated with the Coronavirus pandemic.The program is an acknowledgement of the challenges that many businesses have with accessing funds at the federal and state levels due to the extremely high amounts of applications that are being received by agencies associated with those entities. The Loan program provides funds up to $15,000 and is available to be qualified for-profit small businesses including, sole proprietors, partnerships, corporations, and limited liability companies, that as of March 9, 2020, had been in business within the CRA for at least one year. Qualified small business applicants must be an employer business with between 2 to 100 employees.The loan has a maturity of 18 months at an interest rate of 0%. Only one loan may be made to eligible businesses. The interest rate will be interest-free for a period of 18 months if payments are made on time. The loan may be forgiven for businesses who apply for loans less than $5,000 The program provides a bridge loan of up to $50,000, and is available to be qualified for-profit small businesses including, sole proprietors, partnerships, corporations, and limited liability companies, that as of March 9, 2020, had been in business within the CRA for at least one year.Qualified small business applicants must be an employer business with between 2 to 100 employees. The loan has a maturity of two years at an interest rate of 0%. Only one loan may be made to eligible businesses. The interest rate will be interest-free for a period of two years.  The loan will be fully forgiven if the funds are used for payroll costs, interest on mortgages, rent, and utilities (due to likely high subscription, at least 75% of the forgiven amount must have been used for payroll). Loan payments will also be deferred for six months. Personal guarantees are required. Coronavirus Small Business Sustainability and Recovery Loan Program details: Hallandale Beach, FL – The Hallandale Beach Community Redevelopment Agency (HBCRA) has created an innovated $500,000 stimulus program to assist local small businesses in response to the Coronavirus (COVID-19) crisis.The Coronavirus Small Business Sustainability and Recovery Loan Program was created to address the extremely challenging times associated with the Coronavirus, including the closure of local businesses and the layoff of countless numbers of employees. With the specter of a collapse of our local economy in mind, and a possible increase in slum and blighted conditions, the HBCRA has developed these programs which are designed to work in conjunction with state and federal business disaster recovery programs that have been developed, approved and implemented over the past month.
